The Law of the Shipmaster

The International Law of the Shipmaster is a worldwide survey and analysis of the international Conventions, domestic satutes, international regulations and some of the the principal cases  governing the ocean shipmaster. It is the only single-volume treatise in print reviewing  the history and laws of the shipmaster and of all relevant international organizations, inter-governmental organizations (IGO’s) and non-governmental organizations (NGO’s) of the United Nations (UN) and its member states and of the International Maritime Organisation (IMO) and its member states. The legal regimes of states with civil law traditions and those with common law traditions are compared in the context of the ocean shipmaster.

What the Book Provides

  • A survey of the current international laws affecting the shipmaster as to the international organisations, the Conventions, the domestic laws enabling the Conventions and other domestic laws, jurisdictions, the flag state and the shipmaster’s warrant by his certificate or licence and coastal and port states. Special consideration is given the security and boarding and criminal enforcement regime of the United States and its organs of state security and coast guards.
  • A review of the doctrines of law affecting the shipmaster and his or her relationships, duties, rights and liabilities as to the owner, the charterer, the vessel, labour and passengers, the cargo and the environment.
  • A survey and redaction of the principal statute laws of  96 states registering vessels along with the Conventions which have been ratified and the methods of enablement by statute or otherwise of the Conventions into domestic law. The redactions of laws include, among other things, the powers and authorities of the shipmaster for each state as well as his duties, liabilities, responsibilities and rights.
